Please read these terms and conditions carefully before using Our Service.

Interpretation and Definitions

Interpretation

The words with initial capital letters have meanings defined under the following conditions.
The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

  • Application — the software program provided by the Company downloaded by You on any electronic device, named MySecret AI.
  • Application Store — the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.
  • Affiliate — an entity that controls, is controlled by, or is under common control with a party.
  • Country refers to: United Kingdom.
  • Company (referred to as either "the Company", "We", "Us" or "Our") refers to MySecret AI.
  • Device — any device that can access the Service.
  • Service — the Application.
  • Terms and Conditions ("Terms") — these Terms that form the entire agreement between You and the Company.
  • Third-party Social Media Service — any services or content provided by a third-party displayed through the Service.
  • You — the individual or legal entity using the Service.

Acknowledgment

These Terms govern the use of this Service and form a binding agreement between You and the Company.

By accessing or using the Service, You agree to be bound by these Terms.
If You disagree with any part of them — You may not access the Service.

You represent that You are over 18 years old. The Company does not allow minors under 18 to use the Service.

Your use of the Service is also conditioned on accepting our Privacy Policy, which describes how we collect and process data.

Links to Other Websites

The Service may contain links to third-party websites not owned or controlled by the Company.

The Company is not responsible for the content, privacy policies, or practices of any third-party sites.
You agree that the Company is not liable for any damage caused by using such third-party websites.

We advise you to review their terms and privacy policies.

Subscriptions, Payments, Cancellation and Refunds

This section explains the payment terms that apply when You buy a subscription, virtual credits, or any other paid feature through the Service.

Paid products and checkout disclosures

The Service may offer:

  • paid subscriptions, including Premium access;
  • one-time purchases of virtual credits, including Stars; and
  • paid feature unlocks, add-ons, or other digital benefits.

The price, currency, billing period, included benefits, renewal terms, and any applicable taxes or fees will be shown before You confirm a purchase. By confirming a purchase, You authorize Us and Our third-party payment processor to charge Your selected payment method for the amount shown at checkout.

Payments may be processed by third-party payment processors, including Stripe. Your payment method, card details, fraud checks, and payment authentication may be handled by those processors under their own terms and privacy notices.

Subscriptions and automatic renewal

Paid subscriptions begin when payment is successfully confirmed. Unless the checkout page states otherwise, subscriptions automatically renew for the same billing period at the then-current price, plus any applicable taxes or fees, until cancelled.

You are responsible for keeping Your account and payment details current. If a subscription payment fails, We may retry the charge, ask You to update Your payment method, suspend paid features, or end the subscription.

We may change subscription prices, benefits, or billing terms from time to time. Where required by law, We will provide advance notice before a material change takes effect. If You do not agree to the change, You may cancel the subscription before the next renewal.

Cancellation policy

You may cancel a subscription at any time using Our web app from Your account page at https://mysecret.ai/me or by contacting Us at:

If You contact Us by email, please use the email address connected to Your account, where possible, so We can verify and process the request. Cancellation stops future renewals. Unless We tell You otherwise or applicable law requires a different outcome, You will keep access to paid subscription features until the end of the current paid billing period.

Cancelling a subscription does not automatically refund charges already paid. Deleting Your account, uninstalling the Application, stopping use of the Service, or letting a payment method expire does not cancel a subscription unless the cancellation is confirmed by Us or by the applicable payment provider.

Refund policy

Except where required by applicable law or expressly stated at checkout, payments are final and non-refundable once digital access, virtual credits, or paid features have been delivered or made available.

We may consider refund requests in Our reasonable discretion, including where:

  • You were charged more than once for the same purchase;
  • a charge was unauthorized or fraudulent;
  • a technical issue on Our side prevents delivery or access after reasonable troubleshooting; or
  • applicable consumer law requires a refund, withdrawal right, or other remedy.

Virtual credits, including Stars, are digital items for use only within the Service. They have no cash value, are not legal tender, cannot be exchanged for money, and are non-transferable except where We expressly permit it. Used, redeemed, expired, promotional, bonus, or consumed credits are not refundable except where required by law.

Please include Your account email, purchase date, amount, payment provider receipt or transaction ID, and the reason for the request. We may ask for additional information to verify the purchase and prevent fraud.

Nothing in this section limits any mandatory rights You may have under applicable consumer protection law.

Chargebacks and payment disputes

If You believe a charge is incorrect, please contact Us first so We can investigate. If You initiate a chargeback or payment dispute, We may suspend access to the related paid features while the dispute is reviewed and may share relevant purchase and account information with Our payment processor, bank, card network, or other dispute-resolution provider.

Termination

We may terminate or suspend Your access immediately, without notice, for any reason, including violation of these Terms.

Upon termination, Your right to use the Service ceases immediately.

Limitation of Liability

The Company’s total liability shall be limited to:

  • the amount actually paid by You through the Service, or
  • 100 USD,
    whichever is greater.

The Company shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, business interruption, personal injury, etc.

Some jurisdictions do not allow such limitations; in those cases, liability will be limited to the maximum extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind.

The Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

The Company does not warrant that:

  • the Service will meet Your requirements,
  • the Service will be error-free or uninterrupted,
  • any errors will be corrected,
  • the Service is free of malware or harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so these limitations may not apply to You.

Governing Law

The laws of the United Kingdom govern these Terms, except for conflict-of-law rules.

Your use of the Application may also be subject to other local or international laws.

Disputes Resolution

If You have any dispute with the Service, You agree to try resolving it informally by contacting the Company first.

For EU Users

EU consumers will benefit from any mandatory provisions of the law of their country of residence.

United States Legal Compliance

You confirm that:

  1. You are not located in a country subject to a US embargo or designated as supporting terrorism.
  2. You are not listed on any US government prohibited list.

Complaints, Takedown & Appeals Policy

This section explains how MySecret AI receives, triages, and resolves complaints about content or conduct on the Service, how takedown requests are handled, and how affected parties may appeal Our decisions.

Scope

This Complaints, Takedown & Appeals procedure applies to:

  • all content generated, posted, or transmitted through the Service, including user-generated character profiles, prompts, images, and chat conversations;
  • all reports concerning content or conduct on the Service, whether submitted by users, third parties, rights-holders, regulators, payment partners, or law enforcement; and
  • all enforcement and content-moderation decisions made by the Company.

Categories of content and conduct covered

Complaints and takedown requests may relate to, among other things:

  • non-consensual intimate imagery ("NCII") or any depiction shared without the depicted person's consent;
  • content that depicts, sexualises, or endangers minors, or that may constitute child sexual abuse material ("CSAM");
  • content depicting or facilitating human trafficking, sexual exploitation, or coercion;
  • intellectual-property infringement (copyright, trademark, publicity, likeness);
  • impersonation, doxxing, or unauthorised use of a real person's identity;
  • harassment, threats, hate, or incitement to violence;
  • fraud, scams, malware, or other prohibited security threats; and
  • any other violation of these Terms, Our Privacy Policy, Our Age Restriction and Screening Policy, or applicable law.

How to submit a complaint or takedown request

Complaints and takedown requests must be sent to:

To help Us act quickly and accurately, Reporters are asked to include, where possible:

  1. their full name and contact email;
  2. a clear description of the content or conduct at issue;
  3. the location of the content (URL, character slug, chat reference, screenshot, or other identifier);
  4. the legal or policy basis of the complaint (e.g. non-consent, copyright, CSAM, trafficking, harassment);
  5. for rights-holder claims, proof of ownership or authorisation to act;
  6. for non-consent claims, a statement confirming the Reporter is the depicted person or their authorised representative; and
  7. a good-faith statement that the information provided is accurate.

We accept anonymous reports for safety-critical categories (CSAM, trafficking, threats of violence, NCII), but additional information may be required before We can fully resolve a claim.

Triage, timelines and service levels

We triage incoming complaints based on harm severity and legal risk. Indicative service levels:

  • Priority 0 — CSAM, threats of imminent harm, trafficking indicators: immediate review on receipt; content blocked or removed as soon as identified; preservation and lawful reporting actions initiated without delay.
  • Priority 1 — NCII, doxxing, impersonation of real people, urgent safety risks: initial response within 24 hours; takedown decision targeted within 7 days of a complete report.
  • Priority 2 — IP infringement, harassment, policy violations: initial response within 3 business days; resolution targeted within 7–14 days of a complete report.
  • Priority 3 — Other complaints and general feedback: acknowledgment within 5 business days; resolution as reasonably practicable.

Timelines may be extended where the complaint is incomplete, where legal advice is required, or where law-enforcement coordination is in progress.

Interim measures

Pending full review, We may take interim measures to limit potential harm, including:

  • temporarily blocking, hiding, or restricting access to the reported content;
  • restricting the implicated account, including features such as publishing, payments, or chat;
  • preserving content and metadata for forensic, legal, or law-enforcement purposes; and
  • suspending related characters, prompts, or media generated from the reported content.

Interim measures do not constitute a final decision on the complaint.

Decisions and enforcement actions

After review, We may, in Our reasonable discretion, take one or more of the following actions:

  • remove, block, or restrict access to the content;
  • delete or disable the implicated character, prompt, or media asset;
  • warn, restrict, suspend, or permanently terminate the implicated account;
  • revoke access to features, payments, or rewards;
  • require successful re-verification of age or identity before access is restored;
  • preserve records for law-enforcement, regulator, or payment-partner cooperation; and
  • decline the complaint where We determine that the content or conduct does not violate Our policies or applicable law.

We will notify the Reporter and, where appropriate, the affected user of the outcome by email.

Appeals

Affected users may appeal an enforcement decision. Reporters may also appeal a decision to leave content in place where they believe the original complaint was wrongly rejected.

Appeals must include:

  1. the original complaint or case reference (if any);
  2. the decision being appealed;
  3. the reason the appellant believes the decision is incorrect; and
  4. any new facts, evidence, or context not previously provided.

Appeals are reviewed by personnel not involved in the original decision, where reasonably practicable. We aim to respond to appeals within 14 days of receiving a complete submission. Decisions on appeal are final, subject to any further rights available under applicable law.

Abuse of the complaints process

Submitting knowingly false, misleading, or repetitive complaints, or using the complaints process to harass other users, is prohibited and may itself result in enforcement action against the Reporter, including loss of access to the Service.

Cooperation with law enforcement and partners

Where We identify potential illegal content or conduct (including CSAM, trafficking, or threats of violence), We may, consistent with applicable law:

  • preserve relevant records, content, and account data;
  • report to law-enforcement agencies, child-safety hotlines, or other competent authorities;
  • cooperate with payment partners, card schemes, regulators, and acquiring banks regarding fraud, chargebacks, or scheme-rule compliance; and
  • respond to valid legal process.

Anti-Human Trafficking Policy and Statement

The Company has a zero-tolerance position toward human trafficking, sexual exploitation, forced labour, and any related abuse. This policy applies to all users, content, characters, prompts, chats, and media on the Service, as well as to Our personnel, contractors, and service providers.

Prohibited content and conduct

The Service may never be used to facilitate, depict, promote, or profit from:

  • the trafficking of persons for sexual or commercial exploitation;
  • forced, coerced, or non-consensual sexual activity;
  • child sexual abuse, child sexual exploitation, or any sexualised depiction of minors;
  • the recruitment, transportation, transfer, harbouring, or receipt of persons by means of threat, force, fraud, deception, or abuse of power;
  • sexual slavery, debt bondage, forced prostitution, or commercial sexual exploitation;
  • non-consensual sexual depictions of real, identifiable persons ("NCII");
  • offering or soliciting commercial sexual services, including escort, prostitution, or "in-real-life" sex work; and
  • any conduct prohibited by applicable anti-trafficking, child-protection, or sexual-exploitation laws.

These prohibitions apply equally to AI-generated content, user prompts, character configurations, and human-to-human messaging.

Legal and regulatory framework

We aim to comply with applicable anti-trafficking and child-protection laws, including (without limitation):

  • the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons (Palermo Protocol);
  • the United States Trafficking Victims Protection Act (TVPA) and related federal laws;
  • the United Kingdom Modern Slavery Act 2015 principles regarding transparency and supply-chain due diligence;
  • EU Directive 2011/36/EU on preventing and combating trafficking in human beings;
  • Maltese law in the jurisdiction of incorporation, including provisions of the Criminal Code relating to trafficking and sexual exploitation; and
  • card-scheme and acquirer requirements applicable to adult-content merchants.

Where local laws impose stricter standards, those standards prevail.

Preventative controls

We maintain layered controls intended to prevent trafficking-related content and conduct, including:

  • Age and identity gating: access to the Service is restricted to adults (18+) under Our Age Restriction and Screening Policy, with age verification through Our third-party provider (go.cam).
  • Content classifiers: automated systems are used to detect indicators of minors, non-consent, trafficking, and sexual-exploitation language in prompts, chats, and generated media.
  • Prompt and model safeguards: model-level and system-level instructions are configured to refuse, block, or route to human review any request that suggests trafficking, minors, or non-consensual scenarios.
  • Character review: publicly listed characters are subject to safety and policy review, with takedowns for any character archetypes, descriptions, or imagery that suggest minors, trafficking, or exploitation.
  • Account safety signals: behavioural and account-level signals are used to identify high-risk accounts and prioritise them for review.
  • Vendor due diligence: material vendors and service providers are expected to maintain anti-trafficking and child-safety standards consistent with this policy.

No system can guarantee prevention of all abuse, and these controls operate as a layered defence rather than a single point of enforcement.

Detection, investigation and response

When a potential trafficking or child-safety incident is identified — whether through automated classifiers, hash-matching, complaints, or internal review — We may:

  • immediately remove, block, or restrict access to the content;
  • suspend or permanently terminate the implicated account;
  • preserve content, metadata, and account information for evidentiary and legal purposes;
  • make reports or disclosures to law-enforcement agencies, child-safety hotlines, and other competent authorities where legally required or appropriate; and
  • cooperate with regulators, payment partners, card schemes, and acquiring banks in line with applicable law.

Decisions are made using a risk-based approach aligned with applicable law and platform safety obligations.

How to report a concern

If you suspect human trafficking, child sexual exploitation, or other serious abuse on or via the Service, please report it to Us immediately:

Where possible, please include:

  • a description of the content or conduct;
  • the location of the content (URL, character slug, chat reference, screenshot, or other identifier);
  • the date and time you observed it; and
  • any information that may help Us protect a potential victim.

Reports are reviewed as a priority. We accept anonymous reports for safety-critical categories.

If you believe a person is in immediate danger, please contact local emergency services or an established anti-trafficking hotline in your country first.

Training and vendor expectations

Personnel involved in content moderation, trust & safety, support, and product are briefed on this policy and on recognising indicators of trafficking and child-safety risk. We expect material vendors, contractors, and service providers to maintain anti-trafficking and child-safety standards consistent with this policy and applicable law, to promptly notify Us of any anti-trafficking or child-safety incidents affecting the Service, and to cooperate with reasonable diligence requests. We reserve the right to terminate vendor relationships where We become aware of credible evidence of trafficking, exploitation, or material non-compliance.

18 U.S.C. § 2257 Record-Keeping Exempt Statement †

This statement is published in respect of content made available on or through the Service.

Position summary

The Company claims exemption from the record-keeping and labelling requirements of 18 U.S.C. § 2257 and 18 U.S.C. § 2257A, and from the corresponding regulations at 28 C.F.R. Part 75, on the basis that:

  1. all visual depictions of sexually explicit conduct (if any) appearing on or through the Service are computer-generated or otherwise not depictions of actual human beings engaged in actual sexually explicit conduct;
  2. the Service does not produce visual depictions of actual sexually explicit conduct as defined in 18 U.S.C. § 2256(2)(A) involving real human performers; and
  3. the Service is therefore not subject to the producer obligations imposed by 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75.

To the extent any content on the Service falls outside this exempt category, that content is not solicited, sponsored, or knowingly hosted by Us and is subject to removal under Our content policies.

Why MySecret AI is exempt

The federal record-keeping regime under 18 U.S.C. §§ 2257 and 2257A applies to producers of certain visual depictions of actual sexually explicit conduct by real human performers. MySecret AI's offering is materially different:

  • The Service is an AI companion and chat platform. Characters available on or created through the Service are fictional, AI-generated personas and are not real persons.
  • Visual content rendered on or through the Service is produced by generative AI models based on user prompts and platform safety constraints. Such depictions are not photographs, films, videotapes, digital images, or other matter of an actual person engaged in actual sexually explicit conduct within the meaning of 18 U.S.C. § 2256(2)(A) or the implementing regulations.
  • Accordingly, the Service does not function as a "producer" of "actual sexually explicit conduct" within the meaning of 18 U.S.C. §§ 2257 / 2257A and 28 C.F.R. Part 75.

This statement does not constitute legal advice, and nothing in this statement is intended to assert exemption from any other law. Where any specific content is required by law to be subject to record-keeping or other obligations, the Company will comply with those obligations.

Strict prohibition on minors and real-person sexual content

Regardless of the exemption above, the Company:

  • strictly prohibits any content that depicts, sexualises, or appears to depict minors, and any material that would constitute child sexual abuse material ("CSAM") under any applicable law;
  • strictly prohibits non-consensual sexual depictions of real, identifiable persons ("NCII"); and
  • restricts access to adult-oriented features to users who are at least 18 years old, with age verification through Our third-party provider (go.cam).

Suspected CSAM, NCII, or trafficking-related content is removed and may be reported to law-enforcement and child-safety authorities as legally required or appropriate.

User-generated and third-party content

To the extent users upload, prompt for, or transmit content on the Service:

  • such users retain responsibility for ensuring their content complies with applicable law, including, where applicable, the record-keeping and labelling requirements of 18 U.S.C. §§ 2257 / 2257A; and
  • the Company acts solely as a provider of services described in 47 U.S.C. § 230(c) and as a transmitter, storage provider, or selector/arranger within the meaning of 28 C.F.R. § 75.1(c)(4), and is therefore not the producer of such content.

The Company does not adopt, endorse, or vouch for the lawfulness of any user-generated content beyond Our enforcement obligations under applicable law and Our published policies.

Custodian of Records (where applicable)

For any content that is not exempt under this statement and for which the Company is, in fact, the producer within the meaning of 18 U.S.C. §§ 2257 / 2257A, the records required by those statutes (where applicable) are maintained by the Custodian of Records at:

The exemption claimed above is based on the nature of the AI-generated content on the Service and the absence of real human performers in any sexually explicit depictions hosted by Us. The Company reserves the right to update or clarify this statement as the Service, applicable law, or regulatory guidance evolves.

Severability and Waiver

Severability

If any provision is deemed invalid, it shall be modified to achieve its objective as closely as possible.
The remaining provisions remain in effect.

Waiver

Failure to enforce any right does not waive that right or any future rights.

Translation

In case of discrepancies between translations, the original English version prevails.

Changes to These Terms

The Company may update these Terms at any time.
If the changes are material, we will provide notice at least 30 days in advance.

By continuing to use the Service after changes take effect, You agree to the updated Terms.
